Re: M ________ — Use of Fictitious Business Name

Dear M ________:

This is in response to the letter from ________ dated January 10, 1995, in which he asked whether we would object to ________ using the fictitious name “________” in connection with an arrangement by which it would provide loan processing and documentation services for a federally chartered savings and loan association. In absence, you have requested that we respond to you.

As a general matter, we do not object to ________ using the subject fictitious business name in connection with providing services to or buying loans from another lender. However, we have not reviewed the specific terms of the arrangement in question, and we offer no opinion as to whether the proposed arrangement conforms to any law, regulation or regulatory policy applicable to either ________ or the other participating lender. You have advised us that before entering into the arrangement, ________ will resolve all such issues.
